K-Tag Customer Agreement

A. Use of K-TAG - You agree:

(a) To mount, display and use the K-TAG in accordance with instructions you receive from KTA.
(b) To comply with all state laws and rules of the Kansas Turnpike Authority.
(c) To register any tag(s) purchased at a retail location within 48 hours of first use.

B. Lost, Stolen, Damaged, or Out of Possession:

If the K-TAG is lost, stolen, or no longer in your possession due to the sale of a vehicle, you must notify KTA at once. Notification may be made by telephone, e-mail, or mail. Until you notify KTA of any of the aforementioned circumstances, KTA will continue to charge any fees incurred on your account. Once you have properly notified KTA, the tag will be invalidated. The replacement fee for a new tag varies by K-TAG program. If you have an external or first-generation tag (non-sticker tag), you must return the tag or you may be charged $25 per tag.

C. Termination of K-TAG Account:

KTA may terminate your right to use the K-TAG program at any time. You may also terminate the K-TAG program anytime by calling or e-mailing the KTA. If you have an external or first-generation tag, you must return it to the KTA or you may be charged $25 per tag. Once the request to close your account is received by KTA, your K-TAG will no longer be valid. Any remaining account funds (after all applicable fees and charges have been applied) will be returned to you after the closing process is complete. If you replenish your account by a payment card, a refund will be issued to the card last used. If you replenish your account by cash or check, a refund check will be mailed to the address on file.

D. Returned Checks:

A returned check fee of $30 will be charged for any check not paid on demand by your bank.

E. Late Payments:

A late payment fee of one and one-half (1.5) percent will be charged to any payment not paid within the monthly billing cycle. This includes the K-TAG CLASSIC and the MY K-TAG accounts whose prepaid balance dips below zero or whose payment card is rejected. Other fees may also apply.

F. Reactivation Fee:

If the tag becomes invalid due to nonpayment, it will be deactivated and a $5 fee will be charged to reactivate the tag(s).

G. Charge for statements:

Printed, mailed statements are 50 cents per statement. Checking your account information online is free. If you need additional printed historical statements, there is a $1.50 per page fee for this service.

H. Account Transfer Fee

A $5 transfer fee will be assessed for every account switching from K-TAG CLASSIC into MY K-TAG. The cost of the tag will also be charged.

I. Metal Oxide Windshields:

Some vehicles have treated windshields through which the tag will not work. Any vehicle with an Insta-Clear, Sunguard, or heated front-window system designed for deicing requires an exterior tag. After-market window tints may also interfere with tag performance.

J. Miscellaneous:

(a) KTA may change the terms of this agreement at any time by providing notice to you. Use of the K-TAG after receipt of notice of the new terms is regarded as your consent to the new terms.
(b) You agree to pay all costs, including attorney's fees, incurred by us to enforce the terms of this agreement.
(c) Your use of the KTA website at http://www.ksturnpike.com and/or http://www.myktag.com shall be deemed your consent to modify your information within the K-TAG record system. In the case of a change in payment card information, updates made through the website shall be considered as your authorization for K-TAG to charge (periodically, if applicable) that payment card for the amounts necessary to satisfy your obligations under this agreement.
(d) In order to protect the privacy of your information to the extent allowed or required by law, KTA may require that you provide verifying information to access your account. KTA reserves the right to deny access to your account if the requested verifying information is not provided.

K. Prepaid K-TAG Account Balance:

You are required to establish a prepaid balance with KTA to cover applicable toll charges.
(a) Your initial prepaid K-TAG Account Balance is $40 minimum for one or two tags, then $20 more for each additional tag.
(b) A $1 per month charge for each K-TAG issued to you will be deducted from your prepaid account balance.
(c) The toll charges shall be deducted from your account balance each time the K-TAG is used.
(d) A positive prepaid account balance must be maintained to qualify for a 10 percent discount.
(e) If you pay by payment card, KTA will increase your prepaid account balance by an amount as determined in K(a) by charging your payment card number on file when the account balance falls to zero. The default replenishment amount is $40 for one or two tags and $20 for each additional tag.
(f) If you pay by cash/check, you will not be notified when the prepaid account balance falls to zero. It is your responsibility to monitor the current status of your prepaid account balance to qualify for any discount. Use the K-TAG telephone system at 1-800-873-5824 or the website at http://www.ksturnpike.com or www.myktag.com to monitor your account balance.
(g) KTA reserves the right to adjust the prepaid account balance required for any reason.
(h) You will not receive interest on your prepaid account balances.

Prepaid (K-TAG Classic) Agreement

You accept responsibility for all tags delivered as a result of the application and agree that all charges made by the use of these tags will be your responsibility. You understand that you are subject to all state laws and the rules of the Kansas Turnpike Authority (KTA). If you have circled the payment card option, you agree to maintain a valid payment card. You authorize the KTA to charge your payment card for the amount necessary to satisfy your obligation under this agreement. Should your account fall to zero, the discount will no longer apply and the amount due must be paid by the end of the month following charges or be subject to late payment fees. KTA may invalidate your tag(s) when any part of a statement is past due. Unpaid balances due the KTA may be turned over to a collection agency. You agree to be liable for the use of all tags issued to your account until you notify the KTA at 1-800-873-5824 or ktag@ksturnpike.com, of loss, theft, or unauthorized use.

CREDIT INVESTIGATION REPORT

KTA has the right to investigate the credit of each applicant prior to extension of credit, credit renewal, and update of records. Upon request you will be given the name and address of the credit bureau supplying the report. Also, your signature(s) on the printed application or your online consent will authorize direct release of credit or banking experience to KTA upon their request from any of the references listed. KTA may also report its credit experience with you to any credit bureau.

L. You are required to keep a valid payment card on file with the KTA to cover all toll charges.

M. You must purchase the number of tags you require for your account at a cost of $15 each. Shipping and handling charges apply. Should you require a first generation tag, you must purchase the correct tag at a price of $34.

N. You are not required to prepay your tolls nor will you receive a discount.

O. Your payment card will be charged monthly unless you have less than $10 in tolls on your account. Your payment card will be charged the month following the accumulation in $10 or more in tolls, and/or on the anniversary date of your account.

Purchase (My K-TAG) Agreement

You accept responsibility for all tags delivered as a result of the application and agree that all charges made by the use of these tags will be your responsibility. You understand that you are subject to all state laws and the rules of the Kansas Turnpike Authority (KTA). You agree to maintain a valid payment card on file with the KTA. You authorize the KTA to charge your payment card for the amount necessary to satisfy your obligation under this agreement. If the payment card on file is declined for any reason, you understand that the tags may be subject to immediate invalidation. You agree to be liable for the use of all tags issued to your account until you notify the KTA at 1-800-873-5824 or ktag@ksturnpike.com, of loss, theft, or unauthorized use. Should any tag issued to your account become lost/stolen or out of your possession due to the sale of a vehicle, you understand that a replacement tag must be purchased from the KTA.
