K-TAG User Agreement

A. Use of K-TAG -- You agree:
(a) To mount, display and use the K-TAG in accordance with instructions you receive from KTA.
(b) To comply with all state laws and rules of the Kansas Turnpike Authority.

B. Lost, Stolen or Damaged K-TAGs:
If the K-TAG is lost or stolen, you must notify KTA at once. Notification may be by telephone, fax, e-mail, or mail. Until you notify KTA of a lost or stolen K-TAG, KTA will continue to charge any fees incurred on your account balance. Once you have properly notified KTA that the K-TAG is lost or stolen, the tag will be invalidated. KTA will replace a lost, stolen or damaged K-TAG(s) and charge your account $34.00 per tag.

C. Defective K-TAGs:
If the K-TAG is defective for reasons other than abuse or improper use and the K-TAG is returned to us, KTA will replace it at no charge to you.

D. Termination of K-TAG Account:
KTA may terminate your right to use the K-TAG program at any time. You may also terminate the K-TAG program anytime by returning the K-TAG(s) to KTA in good condition. In the event you do not return the K-TAG(s) in good condition, you will be charged $34.00 per tag.

E. Returned Checks:
A returned check fee of $20.00 will be charged for any check not paid on demand by your bank.

F. Charge for statements:
Printed, mailed statements are 50 cents per month. Checking your account information online is free. If you need additional printed historical statements, there is a $1.50 per page fee for this service.

G. Metal Oxide Windshields:
Some vehicles have treated windshields through which the tag will not work. Any vehicle with an Insta Clear, Sunguard, or heated front window system designed for deicing requires an exterior tag. After-market window tints may also interfere with tag performance.

H. Miscellaneous:
(a) KTA may change the terms of this agreement at any time by providing written notice to you. Use of the
K-TAG after receipt of notice of the new terms, is your consent to the new terms.
(b) You agree to pay all costs, including attorney's fees, incurred by us to enforce the terms of this Agreement.

K-TAG I
I. Prepaid K-TAG Account Balance:
You are required to establish a prepaid balance with KTA to cover applicable toll charges.
(a) Your initial prepaid K-TAG Account Balance is $40 minimum for 1 or 2 tags, then add $20 for each additional tag.
(b) A $1.00 per month charge for each K-TAG issued to you will be deducted from your prepaid account balance.
(c) The toll charges shall be deducted from your account balance each time the K-TAG is used.
(d) A positive prepaid account balance must be maintained to qualify for a ten percent discount.
I. If you pay by credit card, KTA will increase your prepaid account balance by an amount as determined in I(a) by charging your credit card number on file when the account balance falls to zero. The default replenishment amount is $40 for 1 or 2 tags and $20 for each additional tag.
II. If you pay by cash/check, you will not be notified when the prepaid account balance falls to zero. It is your responsibility to monitor the current status of your prepaid account balance to qualify for any discount. Use the our telephone system at 1-800-USE-KTAG or the web site at http://ksturnpike.com to monitor your account balance.
(e) KTA reserves the right to adjust the prepaid account balance required for any reason.
(f) You will not receive interest on your prepaid account balances.

J. Account Termination:
Upon termination of K-TAG account, any remaining balance will be refunded. You must return your K-TAG(s) in good condition or you will be charged $34.00.

K-TAG I Agreement
I/We accept responsibility for all tags delivered as a result of the application and agree that all charges made by the use of these tags will be our responsibility. I/We understand that I/we are subject to all state laws and the rules of the Kansas Turnpike Authority (KTA). If I/ we have circled the credit card option, I/we agree to maintain a valid credit card. I/We authorize the KTA to charge our credit card for the amount necessary to satisfy our obligation under this agreement. Should our account fall to zero, the discount will no longer apply and the amount due must be paid by the end of the month following charges. KTA may invalidate our tag(s) when any part of a statement is past due. Unpaid balances due the KTA may be turned over to a collection agency. I/We agree to be liable for the use of all tags issued to our account until I/we notify the KTA at 1-800-USE KTAG or ktag@ksturnpike.com, of loss, theft, or unauthorized use.

K-TAG II
K. You are required to establish a K-TAG credit account to cover all toll charges. A $5.00 fee per tag is added to the first bill and thereafter on an annual basis.

L. No discount will be received for K-TAG II.

K-TAG II Agreement
I/We accept responsibility for all tags delivered as a result of the application and agree that all charges made by the use of these tags will be our responsibility. I/We understand that I/we are subject to all state laws and the rules of the Kansas Turnpike Authority (KTA). If I/we have circled the credit card option, I/we agree to maintain a valid credit card. I/We authorize the KTA to charge our credit card for the amount necessary to satisfy our obligation under this agreement. Payment is due by the end of the month following charges. If payment is not received by the end of the month following charges, our tags may be invalidated. I/ We agree to be liable for the use of all tags issued to our account until I/we notify the KTA at 1-800-USE KTAG or ktag@ksturnpike.com, of loss, theft, or unauthorized use.
